ملخص الدراسة:

Study Aim To show the role of the judiciary and Hisbah in implementation of human rights in the first Abbasid era. Study Approach The study adopted the descriptive, historical, and analytical approach through collecting the historical narrations from the different resources, analyzing them, and making use of them in the correct places. Results • Islamic Sharia is keen to implement human rights, as shown in the different evidences mentioned in the Noble Quran and Sunnah, in addition to the consensus of the imams and scholars. • The Abbasid State was keen too to establish a robust system with a wide authority in the fields of judiciary and Hisbah in order to maintain human rights, monitor performance of the state in many political, economic and social fields, and highlight the role of the Caliphs in supporting those rights. Recommendations 1. To carry out further studies that focus on the role Hisbah and judiciary in human rights implementation during the second Abbasid era. 2. To highlight leaders and decision makers’ attention to implement Hisbah and judiciary in the Islamic states in a way that is consistent with the Islamic Sharia, and to shed light on the lives of judges and the people of Hisbah in the Abbasid period and to draw lesson from their experience.
