Islamic legislation is distinguished from other statutory legislation by establishing a unique judicial system, characterized by a set of characteristics and features, which made it more reasonable to achieve its goals, objectives, justice and fulfill the right. All those characteristics distinguished the Islamic legislation from other ones, and this is not excess or exaggeration; Rather, it is the truth that this scientific research has proven. By looking at all other studies, whether it is the studies of the old or modern scholars who studied the Islamic judiciary. These characteristics came scattered in their books, organized by this research to prove the fact of distinction of the judicial system in Islam._x000D__x000D_
These characteristics are the relationship between the judiciary and doctrine, its independence from other authorities in the state, the people's trust in it, its observance of the psychological state of litigants and respect for their humanity, its fast action in considering and ruling disputes, seeking to achieve the utmost justice, and equality between opponents._x000D__x000D_
This research was to study these characteristics and know the extent of their impact on the judiciary system in Islam, and how to benefit from them when developing this system, and to explain its merits and importance to other systems.
