ملخص الدراسة:

This research deals with the legal description and analysis of the constitutional structure of the legislative and executive powers. This structure was formed in the wake of the political agreement which known as Oslo - the declaration of Principles on Interim Self-Government Arrangements for the Palestinians signed in Washington on September 13, 1993 Political Convention, between the PLO and Israel , as well as subsequent political agreements and the effects of these agreements in the form and content of the legislative and executive powers as the main component of the new Palestinian political system and up to the date of the split in the Palestinian political system between Fatah and Hamas, and that after the results of the second legislative elections in the Palestinian territories and subsequent legal and practical problems in all the Palestinian political system and the Workflow in all its institutions. In detail, the research presents the way of forming and organizing the specializations of the legislative and executive powers, based on a range of legislation issued by the Palestinian National Authority for the purpose of organizing their work and the relationship between them. The research also presents the fundamental change in the structure of executive power in the Palestinian political system, through the amendment of the Palestinian Basic Law in 2003 and the creation of a prime minister beside the head of the executive branch, and the legal and practical problems resulted from it._x000D_
The research aims to attempt to overcome the imbalance that resulted from the Oslo Accord and subsequent agreements by trying to provide a range of legal solutions in line with the building of contemporary parliamentary democratic political systems, aiming to get future advantage, especially in light of the current action by the Palestinian leadership to complete the draft of the Palestinian constitution which will determine the future nature and form of the Palestinian political system.
